1. Agreement to Terms

By accessing or utilizing the consulting, auditing, or project management services offered by DFT Elevators, you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully.

2. Scope of Services

DFT Elevators provides independent vertical transportation advisory, safety audits, modernization specification drafting, and compliance reviews. Our services are advisory in nature. While we perform thorough reviews, building owners remain solely responsible for executing compliance repairs through qualified elevator service contractors.

3. Client Responsibilities

Clients must provide DFT Elevators with full, unimpeded access to elevator machinery spaces, maintenance records, previous inspection logs, and contractor invoices. The client is responsible for coordinating with building personnel and tenants to ensure safe testing conditions during active audits.

4. Fees, Invoicing, & Payments

Consulting fees are invoiced based on agreed project milestones or hourly rates detailed in your individual Service Proposal. Invoices are payable within thirty (30) days of receipt. Late payments are subject to a fee of 1.5% per month on outstanding balances.

5. Limitation of Liability

DFT Elevators operates as an independent advisory firm. Under no circumstances shall DFT Elevators be liable for indirect, incidental, or consequential damages (including loss of profits, building downtime, or tenant claims) arising from elevator mechanical failures. Our total liability under any service contract shall be capped at the total amount paid to us for the specific service in question.

6. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California. Any legal actions or proceedings arising from these terms shall be initiated in the state or federal courts located in San Francisco County, California.

7. Amendments

We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on this page and are effective immediately upon publication.
